17、conferringapresumptionofconfmityonmachinerythesafeguardclauserelatingtomachinery.就市場(chǎng)監(jiān)督而言，宜在質(zhì)疑用于機(jī)械符合性假定的協(xié)調(diào)標(biāo)準(zhǔn)與機(jī)械保障條款之間的設(shè)置明顯的差別。(12)TheputtingintoserviceofmachinerywithinthemeaningofthisDirectivecanrelateonlytotheuseofthema

20、themarketofcertaintypesofmachinerypresentingthesameriskstothehealthsafetyofpersonseitherduetoshtcomingsintherelevantharmonisedstard(s)byvirtueoftheirtechnicalacteristicstomakesuchmachinerysubjecttospecialconditions.Inder

21、toensuretheappropriateassessmentoftheneedfsuchmeasurestheyshouldbetakenbytheCommissionassistedbyacommitteeinthelightofconsultationswiththeMemberStatesotherinterestedparties.Sincesuchmeasuresarenotdirectlyapplicabletoecon

25、accountofthisinthedesignconstruction.Thesameapplieswhereamachineisnmallyusedtoprovideaservicetoaconsumer.如果機(jī)械可能被消費(fèi)者使用，即由非專業(yè)操作人員使用，則制造商應(yīng)在設(shè)計(jì)和制造時(shí)予以考慮。這也適用于通常用于為消費(fèi)者提供服務(wù)的機(jī)器。(16)AlthoughtherequirementsofthisDirectivedonotapply
